Madonna sued over sample

Another singer is being sued over using samples that they did not license, but only after special software recognized the sound deep in the mix.

In May, the Beastie Boys were sued for allegedly using samples from the group Trouble Funk after "careful audio analysis...including isolating the suspected portion of the recording."

Now it's Madonna being sued by VMG Salsoul for copyright infringement, saying that string and horn parts of the Salsoul Orchestra's 1977 song Ooh I Love It (Love Break) was buried in the mix on her giant hit Vogue. According to the suing part, the sample was purposely buried in the mix to avoid detection and was only detected through the use of sophisticated software analysis.

Now, here's the twist with this particular case. The original song by the Salsoul Orchestra was mixed by Richard "Shep" Pettibone who also mixed Vogue.

The company is suing for damages and a portion of the profits from the recording.
